IMPORTANT: PLEASE READ CAREFULLY

By accessing, applying to, subscribing to, purchasing from, or using Nomi’s website, services, membership, events, or related offerings, you agree to these Terms of Service (“Terms”). These Terms form a legally binding agreement between you and Nomi.

By ticking the agreement box at sign-up, submitting an application, or completing payment, you confirm that you have read, understood, and agreed to these Terms.

1. WHO WE ARE

Nomi is a curated membership-based relationship and connection platform that offers:

  • Membership applications

  • Member vetting

  • Curated introductions

  • Optional micro-community events

  • Subscription-based access to services

Nomi is not a marriage broker, licensed counselling provider, or guarantor of romantic outcomes.

2. ELIGIBILITY

To use Nomi, you must:

  • Be at least 18 years old

  • Provide truthful, accurate, and current information

  • Be legally able to enter binding contracts

  • Use Nomi only for lawful, personal purposes

  • Not impersonate another person

  • Not use Nomi for harassment, exploitation, fraud, or commercial solicitation

Nomi may reject, suspend, or terminate applications or memberships at its sole discretion where safety, dishonesty, misuse, or community concerns arise.

3. MEMBERSHIP APPLICATION + PAYMENT

Founding Membership Registration Fee

Your registration fee covers:

  • Application processing

  • Profile review

  • Vetting and screening

  • Administrative onboarding

  • Match consideration

  • Platform and service access setup

Unless required under New Zealand law (including applicable consumer protections), registration fees are generally non-refundable once services have commenced or application review has materially begun. Consumer rights under the Consumer Guarantees Act cannot be excluded. (Consumer Protection)

4. SUBSCRIPTION BILLING

By subscribing, you authorise Nomi (or its payment processor) to charge your nominated payment method for:

  • One-time registration fees

  • Monthly recurring membership fees

  • Any clearly disclosed future charges you expressly agree to

Subscription Terms:

  • Membership renews automatically unless cancelled

  • You may cancel anytime through your account settings or designated support channels

  • Cancellation stops future renewals but generally does not retroactively refund completed billing periods unless required by law

  • Failed payments may result in suspended access

Nomi must clearly disclose pricing, billing frequency, and material terms in line with New Zealand fair trading obligations. (Business.govt.nz)

5. NO GUARANTEE OF MATCHES OR RELATIONSHIP OUTCOMES

Nomi provides introductions, experiences, and curated opportunities only.

We do not guarantee:

  • Romantic matches

  • Relationship success

  • Compatibility

  • Meeting frequency

  • Event attendance

  • Member responsiveness

Human relationships are inherently personal and unpredictable.

6. MEMBER CONDUCT

You agree to:

  • Treat all members respectfully

  • Communicate honestly

  • Respect boundaries and consent

  • Avoid harassment, abuse, coercion, discrimination, intimidation, or stalking

  • Not misuse member data or personal information

  • Not share private member information without consent

  • Not use Nomi for escorting, solicitation, scams, or deceptive conduct

Nomi reserves the right to investigate complaints and suspend or permanently remove members for misconduct.

7. SAFETY DISCLAIMER

Nomi may conduct screening, vetting, moderation, or verification measures, but no system can guarantee the behaviour, identity, or intentions of any person.

You remain responsible for:

  • Personal decisions

  • In-person meetings

  • Background checks you independently choose to undertake

  • Your own physical, emotional, and digital safety

Always meet responsibly.

8. EVENTS + MICRO-COMMUNITY EXPERIENCES

Participation in optional gatherings, events, or experiences is voluntary.

By participating, you acknowledge:

  • Social interactions carry personal risk

  • Nomi does not guarantee attendee behaviour

  • Nomi is not liable for personal disputes, chemistry, compatibility, or conduct beyond its reasonable control

You may be removed from events or memberships for unsafe or disruptive behaviour.

9. PRIVACY + DATA USE

Your use of Nomi is also governed by our Privacy Policy.

By using Nomi, you consent to the collection and use of your information for:

  • Membership administration

  • Matchmaking consideration

  • Safety screening

  • Billing

  • Service improvement

Nomi will handle personal information in accordance with New Zealand privacy obligations.

10. CONSUMER RIGHTS

Nothing in these Terms excludes, limits, or overrides any rights you may have under New Zealand law, including:

  • Consumer Guarantees Act 1993

  • Fair Trading Act 1986

  • Privacy Act 2020

11. INTELLECTUAL PROPERTY

All Nomi branding, website content, materials, questionnaires, systems, copy, and experiences are owned by Nomi unless otherwise stated.

You may not:

  • Reproduce

  • Copy

  • Sell

  • Republish

  • Exploit

…without written permission.

12. ACCOUNT TERMINATION

Nomi may suspend or terminate your membership without refund (subject to applicable law) if:

  • You breach these Terms

  • You behave unsafely

  • You misuse the platform

  • You provide false information

  • You create legal or safety risks

You may also cancel your membership at any time.

13. LIMITATION OF LIABILITY

To the maximum extent permitted by law, Nomi is not liable for:

  • Personal decisions or member interactions

  • Romantic outcomes

  • Emotional distress arising from interpersonal experiences

  • Indirect or consequential loss

  • Third-party misconduct

  • Event incidents beyond reasonable control

  • Temporary website downtime or technical interruptions

Nothing here excludes liability where exclusion would be unlawful.

14. CHANGES TO SERVICES OR TERMS

Nomi may update:

  • Pricing

  • Membership features

  • Community standards

  • These Terms

Where material changes occur, reasonable notice will be provided.

Continued use after updates constitutes acceptance.

15. DISPUTES

These Terms are governed by New Zealand law.

Any disputes will be handled under applicable New Zealand legal processes unless otherwise required.
